Understanding Work Permits 

A work permit is an official document issued by Immigration, Refugees and Citizenship Canada (IRCC) that authorizes foreign nationals to work in Canada. Work permits can be categorized into two types: closed and open. Closed work permits limit the holder to specific occupations, employers, and work locations, whereas open work permits are more flexible and impose no such restrictions.

However, all other potential employees must first secure a work permit, even for unpaid roles such as internships.

To support a candidate in obtaining a work permit, there are primarily two pathways: through a job backed by a Labour Market Impact Assessment (LMIA) or through LMIA-exempt offers. Without a valid job offer, candidates cannot proceed with a work permit application. If they are ineligible for an open or LMIA-exempt permit, an LMIA will be necessary. 

What is a Labour Market Impact Assessment (LMIA)? 

An LMIA, issued by Employment and Social Services Canada (ESDC), permits the hiring of foreign workers, ensuring that all efforts have been made to recruit Canadian citizenship and permanent residents first. Employers must comply with immigration and labor laws and prove they have attempted to hire domestically before receiving an LMIA. 

Eligibility and Types of LMIA 

Employers, including foreign entities and start-ups, can apply for various types of LMIA, such as: 

  • Global Talent Stream (GTS) LMIA
  • High-wage and Low-wage position LMIA
  • LMIA for permanent residence
  • Academic position LMIA
  • LMIA for primary agriculture positions
